Bourgon focuses her practice on general civil litigation and she has experience in both the public and private sector. While at the Arkansas Attorney General’s Office, Bourgon successfully represented the State of Arkansas in civil litigation matters in both Arkansas and federal courts, including the Arkansas Supreme Court and the United States Court of Appeals for the Eighth Circuit. Her experience includes being lead attorney on issues of constitutional law and statutory interpretation as well as in employment matters.

In her private practice, Bourgon handles a wide variety of civil disputes including contract litigation, antitrust and class action litigation, insurance coverage disputes, personal injury defense, collections on behalf of entities and individuals, and probate litigation. She also has extensive experience managing complex electronic discovery matters.

Bourgon’s experience includes:

  • Arguing on behalf of the State of Arkansas before the United States Court of Appeals for the Eighth Circuit in an employment discrimination matter
  • Defending the State of Arkansas against claims made under the Civil Rights Act, 42 U.S.C. § 1983
  • Defending the State of Arkansas and its laws in the Arkansas Supreme Court
  • Joining as amici counsel in the Arkansas Supreme Court in a matter of importance to the State
  • Defending the State of Arkansas against various employment discrimination claims and claims arising under the Arkansas and U.S. Constitutions in state and federal court
  • Defending against Federal Employers Liability Act and common carrier claims
  • Representing clients in replevin actions to reclaim property
  • Defending against personal injury claims
  • Managing complex electronic discovery
  • Representing clients in antitrust litigation
  • Representing clients in class action litigation
  • Representing multi-national client against products liability claims
  • Representing client in appeal of probate matter
  • Representing and advising client on commercial lease disputes
  • Litigating commercial lease and unlawful detainer lawsuits
  • Representing clients against OSHA citations and before the Nuclear Regulatory Commission
