Frank H. Falkner practices in the areas of General and Commercial Litigation, Bankruptcy and Creditors’ Rights, and Administrative Law. Frank’s law practice has involved the following:
- General, commercial, business, and contract litigation, disputes, and fraud
- Probate and trust litigation
- Administrative actions before state and federal regulatory agencies
- Obtaining and collecting on judgments
- Replevin and obtaining and enforcement of security interests
- Judicial real estate foreclosures, lease, unlawful detainer, and materialman’s lien litigation
- Filing of proofs of claim to ensure that the client shares in the debtor’s bankruptcy “estate”
- Filing of motions for relief from stay to remove collateral from the bankruptcy court’s “automatic stay” when debtors are not paying for their collateral
- Filing objections to plans of reorganizations when debtors do not properly provide for our client’s debt in their plan
- Defending preference suits brought by the trustee when the trustee is seeking repayment of monies that the debtor paid the client leading up to the bankruptcy
- Filing administrative 503(b)(9) claims for goods shipped within 20 days before the bankruptcy
- Representing clients in adversary proceedings brought within the bankruptcy case.

Bankruptcy and Creditors’ Rights:
Frank has focused on the creditor side of bankruptcy cases, representing secured and unsecured creditors, and asset purchasers in a variety of types of bankruptcy and commercial litigation at both the trial and appellate court levels. Frank has successfully defended preference suits and other adversary proceedings in bankruptcy court. Frank accurately assesses the client’s situation based on their unique industry and particular facts and issues related to the transaction to maximize return on equity or minimize potential financial exposure.
Litigation/Disputes:
Frank handles all manner of general disputes, including commercial disputes, business disputes, breach of contract actions, breach of lease transactions, trust and probate litigation. Frank has handled disputes among owners of limited liability companies, owners of small corporations, and other entities. Frank has handled closely held shareholder derivative actions and both defended and prosecuted “pierce the veil” actions on behalf of his clients. Frank handles complex business litigation and dedicates himself to the legal research needed to win his client’s case.
Administrative Law/Appeals:
Frank has handled matters in front of the Arkansas Motor Vehicle Commission, the Arkansas Department of Human Services, the United States Social Security Administration, the Office of State Procurement and the Appellate Courts of Arkansas.
