Tori focuses her practice on labor and employment law, regulatory/administrative law, general civil and commercial litigation, and government relations.  She represents employer/management interests in a variety of areas such as: wage and hour actions and investigations, OSHA and non-OSHA citations and safety and compliance audits, employment contract disputes, covenants not to compete, Family and Medical Leave issues, management contract negotiation with unions, assisting as legal counsel during opposition to union organizing campaigns, union grievances and arbitrations, labor disputes and arbitrations, charges of discrimination, reductions in force, and drafting of employer-specific documents such as handbooks, severance agreements, and employment contracts.

Experience

Tori’s recent experience includes representation of clients in:

  • Management labor and employment matters such as Title VII, Sections 1981 and 1983, Family and Medical Leave Act, Uniformed Services Employment and Reemployment Rights Act, Americans with Disabilities Act, Arkansas Civil Rights Act, Age Discrimination in Employment Act, Fair Labor Standards Act, Surface Transportation Assistance Act, Older Workers Benefit Protection Act, Worker Adjustment and Retraining Notification Act, National Labor Relations Act, and Occupational Safety and Health Act
  • Wage and hour actions including Department of Labor investigations, actions brought under the Arkansas Minimum Wage Act, and individual and collective actions brought under the FLSA
  • Charges of discrimination and cases before the Equal Employment Opportunity Commission
  • Unfair labor practice charges, investigations, and cases before the National Labor Relations Board
  • Drafting employer-specific documentation such as handbooks, applications, and severance agreements
  • Employment-related business restructuring needs including, but not limited to: reductions in force and notices required under the Worker Adjustment and Retraining Notification Act
  • Providing legal counsel to employers to oppose union organizing campaigns
  • Assisting employers with the negotiation of collective bargaining agreements with unions
  • Training management and personnel in employment-related matters
  • Conducting OSHA and non-OSHA safety, health, and compliance audits
  • Defense of OSHA citations
  • OSHA litigation
  • Investigations and implementation of directives from the Office of Federal Contract Compliance Programs

  • Commercial contract disputes
  • Presenting continuing legal education courses and other training courses
  • Conducting commercial litigation document review
  • Handling all aspects of general and commercial civil litigation from drafting pleadings to conducting depositions to participating in trials, including appellate work
