Russell concentrates his practice in the areas of workplace safety and health compliance and litigation. This includes the following:

  • Counseling clients on compliance with Occupational Safety and Health Administration (OSHA) regulations
  • Investigating and responding to significant workplace incidents
  • Managing OSHA inspections
  • Contesting OSHA citations
  • Defending employers during OSHA enforcement actions
  • Conducting internal safety and health audits
  • Developing safety and health programs and policies

He also represents clients in personal injury and wrongful death litigation following workplace incidents.

Experience

  • Counsels clients on all aspects of occupational safety and health compliance and related State and Federal regulatory enforcement proceedings
  • Routinely conducts onsite safety and health audits to help recognize, correct and prevent potential workplace safety and health hazards
  • Reviews and develops written safety and health programs, workplace safety rules, operating procedures, job safety/hazard analyses and other related policies and procedures
  • Counsels clients on injury and illness recordkeeping and reporting requirements, including whether injuries or illnesses must be recorded on OSHA 300 logs or whether injuries or illnesses must be reported to OSHA as amputations or hospitalizations
  • Assists and prepares clients by providing on-the-ground guidance during OSHA inspections related to workplace incidents, accidents, hospitalizations, amputations, fatalities, catastrophes, complaints and National, Regional and Local Emphasis Program enforcement
  • Consults with clients concerning existing and developing regulatory requirements and applicability to business operations
  • Represents clients through all stages of State and Federal regulatory inspections, including onsite inspections, closing conferences, informal settlement conferences and litigation
  • Works with clients to help achieve participation and recognition in OSHA’s Voluntary Protection Programs (VPP)

  • Represented manufacturer in defense of multiple violations of OSHA’s Lockout/Tagout Standard
  • Represented national trucking company in defense of multiple violations of OSHA’s Walking-Working Surfaces Standard, Respiratory Protection Standard, Permit-Required Confined Spaces Standard, Electrical Standard and Hazard Communication Standard
  • Represented manufacturer in defense of willful violation of OSHA’s Electrical Standard and repeat violation of OSHA’s General Duty Clause
  • Represented manufacturer during onsite OSHA inspection related to in-plant railroad fatality
  • Represented manufacturer during onsite OSHA inspection of crane-related fatality
  • Represented manufacturer in defense of multiple violations of OSHA’s Process Safety Management Standard
  • Represented manufacturer in defense of violation of OSHA’s Crane Standard
  • Represented manufacturer in defense of violation of OSHA’s Machine Guarding Standard
  • Represented manufacturer in defense of multiple violations of OSHA’s Machine Guarding Standard, Emergency Egress Standard and OSHA General Duty Clause
  • Represented client in defense of multiple violations of OSHA Crane Standard, Sling Standard, Walking/Working Surface Standard and General Duty Clause
