New Markets Tax Credit

The New Markets Tax Credit (NMTC) program allows qualifying businesses —both for-profit and nonprofit —to finance or reimburse eligible expenditures on a highly subsidized basis. A typical transaction includes an interest-only repayment period of seven years, followed by an unwind feature that results in the complete forgiveness of up to 25 percent or more of the amount borrowed. Although these transactions can be complex, our team has significant experience and a deep knowledge of the process.

Rose Law Firm attorneys have participated in transactions involving the combination of New Markets Tax Credits with other incentives, such as historic rehabilitation tax credits. The firm has utilized conventional and NTMC financing for the construction of a charter school campus and a steel pipe manufacturer, as well as the expansion of a national textbook distributor, a nursing school, a children's museum, and a window and door manufacturer.

Our attorneys are prepared to assist project sponsors in undertaking, negotiating, and documenting NMTC transactions and have experience in transactions across the United States.
