Nancy Smith

Nancy Smith is a member in the Northwest Arkansas office, where her practice focuses on complex civil litigation. Nancy has broad experience advising clients on high-stakes litigation and contract matters across industries, including the small-business, antitrust, and privacy sectors. She litigates in both federal and state court, including multi-district and class action proceedings, and has experience at all stages of litigation. Her work includes pre-litigation counseling, writing dispositive motions and briefs, preparing witnesses for deposition and trial, managing large-scale discovery, handling settlement negotiation, preparing for trial and mediation, and representing clients on appeal.

Prior to joining the firm, Nancy attended the University of Arkansas and the University of Arkansas School of Law. Nancy graduated from the University of Arkansas School of Law with the highest honors, served as the Managing Editor of the Arkansas Law Review, and completed externships with the Arkansas Supreme Court and the Tyson Foods Legal Department. In addition to her practice, Nancy is actively involved in the Northwest Arkansas community. She is a recent graduate of Leadership Benton County, serves on the Kappa Kappa Gamma House Board of Directors, and is a member of the W.B. Putman American Inn of Court.

Bourgon B. Reynolds

Bourgon Reynolds is the managing member of Rose Law Firm’s Northwest Arkansas office. She is a highly accomplished lawyer who represents companies and individuals as both plaintiffs and defendants in high-stakes, complex civil litigation. Her experience spans matters involving complex contractual disputes, antitrust, unfair trade practices, fraud, non-competition and non-solicitation, privacy laws, probate and trust litigation, class actions, and consumer protection. She serves clients across various industries including poultry, advertising technology, healthcare, finance, insurance, transportation and logistics, and retail suppliers. She has also represented clients in cases or investigations adverse to the Department of Justice, various attorneys general, the Federal Trade Commission, the Consumer Financial Protection Bureau, the Arkansas State Medical Board, and other government regulators.

After several years in Rose Law Firm’s Little Rock office, Bourgon joined the Arkansas Attorney General’s Office, where she successfully represented the State in civil litigation on issues of statutory and constitutional interpretation, including appeals before the Arkansas Supreme Court and the U.S. Court of Appeals for the Eighth Circuit. Originally from Northwest Arkansas, she rejoined Rose Law Firm in 2018 after returning to the region and has since represented clients in business disputes in federal and state courts nationwide.

Ms. Reynolds has an active pro bono practice, such as serving as lead counsel in a complaint brought by detainees at a local jail who were given medications as a supposed treatment for COVID-19 without their informed consent in violation of their constitutional rights. She is also a member of the firm’s Executive Committee.

David Mitchell, Jr.

David Mitchell, Jr. is the youngest managing member in the history of Rose Law Firm.  David focuses his practice on complex business and corporate litigation, serving as lead counsel for public and private companies, their owners, executives, and directors in high-stakes disputes, arbitrations, and trials. He advises a diverse range of industries, including financial services, construction, agriculture, healthcare, pharmaceuticals, and professional services.  David routinely guides clients through intricate corporate governance issues, shareholder disputes, contract breaches, and business torts. He also represents clients in regulatory and administrative proceedings before key Arkansas agencies, such as the Board of Pharmacy, Medical Marijuana Commission, Development Finance Authority, Bank Department, and Motor Vehicle Commission.

Ryan J. Smith

Ryan is a distinguished attorney based in Northwest Arkansas and has extensive experience resolving complex commercial litigation disputes. Ryan has built a reputation for his strategic approach, attention to detail, and unwavering commitment to his clients. He has successfully represented clients in disputes involving contracts, business torts, shareholder issues, and probate and trust administration. He also represents industry leaders in front of various administrative tribunals in Arkansas, including the Arkansas State Board of Pharmacy and the Arkansas Medical Marijuana Commission.

Ryan is also a member of the firm’s Intellectual Property team. He is passionate about helping clients protect their innovative ideas and creations, assisting them in securing and protecting their intellectual property rights across various industries.

Prior to joining Rose Law Firm, Ryan served as a judicial law clerk for the Honorable P.K. Holmes, III, of the United States District Court for the Western District of Arkansas.

David M. Powell

David focuses his practice on construction disputes through litigation, mediation and arbitration as an attorney and dispute resolution appointee as well as defense of design professionals. In addition, he counsels clients in the areas of business litigation, financial institution forms compliance, commercial transactions, real estate, professional liability and commercial arbitration. He is one of the editors of the Arkansas Construction Law Manual.

Christopher A. McNulty

Chris McNulty is a commercial litigator who focuses his practice on helping financial institutions in compliance, bankruptcy, and foreclosure matters. He represents creditors in bankruptcies and workouts of troubled commercial loans, leases and other contractual relationships, including DIP financing and Chapter 11, 12 and 13 plans of reorganizations. Chris also counsels clients in a wide variety of business and agricultural disputes in state, federal, and administrative courts. He has extensive experience in foreclosure, commercial landlord/tenant issues, breach of contract, receivership, business torts, and open account disputes.

Ross E. Simpson

Ross E. Simpson practices primarily in the areas of management-side labor and employment law, civil litigation, and commercial litigation. Ross’ experience includes defending employers in state and federal courts in single-plaintiff, multi-plaintiff, and class/collective actions involving allegations of discrimination, harassment, retaliation, and wage-and-hour violations, as well as in other civil and commercial litigation. Outside of the courtroom, Ross guides employers through investigations into alleged unlawful conduct by the EEOC, DOL, NLRB, and state and local agencies. Ross also provides “preventative” legal services by aiding clients in developing, drafting, and interpreting handbooks, manuals, rules, and policies in accordance with applicable laws and regulations, and Ross prepares and negotiates employment agreements, separation agreements, restrictive covenants, and other business-related contracts.

Ross served for over four years as a Judicial Term Clerk to the Honorable Susan O. Hickey, District Judge of the United States District Court for the Western District of Arkansas, where he gained extensive and unique insight into the inner workings of the federal judiciary that now informs his litigation practice. Ross obtained his Juris Doctor from the University of Arkansas School of Law, where he graduated magna cum laude and served as the Executive Editor of the Arkansas Law Review. Ross also received a B.A. in Political Science from the University of Arkansas.

Paul Parnell

Paul is member and chief financial officer, whose practice focuses on commercial financing transactions, new markets tax credit financings, mergers and acquisitions and all aspects of federal and state tax planning, with an emphasis on individual, estate and gift, corporate and flow through tax planning.

Paul is a frequent speaker at continuing education seminars hosted by the Arkansas Bar Association and the Arkansas Institute of Certified Public Accountants.

Chambers USA describes Paul as a “‘a very skilled tax attorney, which forms part of his broad corporate practice,'” leading to Chambers recognizing Paul in two practice areas, Corporate Commercial and Corporate Commercial – Tax.

Michael D. McGill

Michael is a member in the firm’s business section and works in the firm’s Northwest Arkansas office.  He focuses his practice on estate planning, estate and trust administration, estate and gift taxation, business formation, and nonprofit organizations.  He is a graduate of New York University, where he earned an LL.M. in Taxation, and a graduate of the University of Arkansas School of Law.  Prior to his legal studies, Michael graduated from the Sam M. Walton College of Business at the University of Arkansas.

Michael is actively involved with the Mercy Health Foundation Planned Giving Committee.  He is a graduate of Class III of the American College of Trust and Estate Counsel Heart of America Fellows Institute.

Brian Rosenthal

Brian serves as counsel in acquisitions, refinancings, and investments, covering contract mail carriers, poultry companies, energy and manufacturing, grain handling and processing, and in railroad negotiations.

He continues to be involved in defending, negotiating, and preserving property and permit rights and interests before multiple municipal, state, and federal agencies and regions, including involving the environmental media of air, solid waste, water, and hazardous waste; brownfield properties; negotiated, elective site compliance and review; and penalty and operational requirement review and negotiation.

Brian is frequently consulted on unusual contractual or litigation situations involving creative resolutions to disputes.

Tyler Mlakar

Tyler is an associate attorney in the firm’s litigation section.  He is a general litigator with a particular focus on construction law.  Prior to joining Rose Law Firm, Tyler served as a judicial law clerk for the Honorable Bobby E. Shepherd, of the United States Court of Appeals for the Eighth Circuit.  Tyler earned his J.D. from the University of Arkansas School of Law in 2022, where he served as the Executive Editor of the Arkansas Law Review and became the first student in the law school’s history to graduate at the top of his class with a perfect GPA.  Tyler has received national awards for his legal writing and furthers his passion for it as a member of the Editorial Advisory Board for The Arkansas Lawyer—the flagship publication of the Arkansas Bar Association.

E. Joseph McGehee

Joey is committed to building long-term client relationships based on trust and results. He started his career with a successful general law practice at a prominent Arkansas law firm. He gained a breadth of experience and representing individuals and businesses in a variety of lawsuits. He also counseled clients on corporate law, real estate law, trusts, and estates. As a member of Rose Law Firm, Joey continues to concentrate on litigation.

Joey graduated from the University of Arkansas School of Law with the highest honors and as a member of the Arkansas Law Review. In law school, Joey completed externships with a Benton County Circuit Judge and the Wal-Mart Legal Department. Before law school, he studied economics and finance at the Sam M. Walton College of Business.

Leadership is a central tenet for Joey. He is the immediate past president of the W.B. Putman American Inn of Court, the former president of the Benton County Bar Association, a graduate of Leadership Benton County, and an alumnus of National Outdoor Leadership School.
